This notice is intended for visitors located in the European Economic Area (EEA), the United Kingdom, and Switzerland, and applies to the extent the EU GDPR and/or UK GDPR applies to our processing of personal data (including where services are offered to individuals in these regions).

Depending on how you interact with deshima-music.com, we may collect:

- Basic usage/log data (pages viewed, timestamps, referring/exit pages)

Where GDPR applies, we process personal data for the following purposes and legal bases:

A. Responding to inquiries and communications

To reply to messages, provide information, and take steps prior to a contract.

Legal basis: Art. 6(1)(b) GDPR and/or Art. 6(1)(f) GDPR (legitimate interests in operating and growing our business).

B. Licensing coordination (via partners)

If you request licensing, we may share relevant details with our licensing partners to facilitate availability, pricing, and licensing terms.

Legal basis: Art. 6(1)(b) and/or Art. 6(1)(f) GDPR.

C. Website operation, security, and improvement

To secure the site, prevent abuse, troubleshoot, and improve performance and content.

Legal basis: Art. 6(1)(f) GDPR (legitimate interests in security and service improvement).

D. Optional analytics/marketing cookies (if enabled)

Where required, non-essential cookies are used only with consent.

Legal basis: Art. 6(1)(a) GDPR (consent).

4) Recipients of Personal Data

We may disclose personal data to:

- Service providers (e.g., hosting, email, security, analytics) acting as processors under contract

- Licensing partners when you request licensing or licensing-related support

- Professional advisors (legal/accounting) where necessary

- Authorities where required by law or to protect rights/safety

5) International Transfers (EEA/UK/CH)

We are based in the United States. Your data may be transferred to and processed in the U.S. and other countries where we or our vendors operate.

EEA transfers: Where required, we rely on recognized safeguards such as the EU Standard Contractual Clauses (SCCs) under Commission Implementing Decision (EU) 2021/914.

UK transfers: Where required, we rely on UK transfer tools such as the International Data Transfer Addendum (or IDTA) as described by the UK ICO.

You are not required to provide personal data to browse the site. If you choose not to provide certain information (e.g., via a contact form/email), we may be unable to respond fully or process your request.

11) Automated Decision-Making

We do not use personal data for solely automated decision-making (including profiling) that produces legal or similarly significant effects.

12) EU/UK Representative (if required)

If our processing falls under Article 3(2) GDPR and an EU/UK representative is required, we will designate one and publish the representative’s contact details on this page.

We may update this GDPR Notice from time to time. Changes will be posted on this page with an updated effective date.
